Domaiya Terms of Use (End User Licence Agreement)
Version 1.1 · Effective 27 September 2026 Provider: BERFLOW LTD (Cyprus, registration number HE 446915)
IMPORTANT: PLEASE READ THESE TERMS CAREFULLY.
These Terms of Use (the Terms) are a legally binding agreement between you and BERFLOW LTD, a private company limited by shares registered in the Republic of Cyprus under registration number HE 446915, with its registered office at Miltonos 109A, 3047 Limassol, Cyprus (BERFLOW, we, us, our).
The Domaiya application is offered under the BerflowIT brand and published on Google Play under the developer name BerflowIT. BerflowIT is a brand, not a separate company.
These Terms govern your access to and use of the Domaiya mobile application, its web pages, its communications, and all related features, content and services (together, the Service).
These Terms set out the conditions on which we offer the Service. Publishing them does not by itself establish that an existing user has received or accepted new contractual conditions. We will give appropriate notice and obtain agreement where required before applying new conditions. Optional data-processing consent and any purchase require their own separate choices. Nothing in this notice removes rights or remedies that have already arisen.
If you are a consumer, nothing in these Terms affects the rights you have under the mandatory laws of the country where you live.

1. Definitions
1.1 In these Terms:
- Account: your personal Domaiya account.
- AI Features: features of the Service that use machine-learning models to generate, extract, transcribe, summarise, suggest or propose actions on information.
- Child Profile: a member record for a child, created and managed by the child's Guardian.
- Consumer: an individual acting for purposes outside their trade, business, craft or profession.
- Guardian: a parent, or another person with legal authority to act for a child. Being an Owner or a Manager of a Household does not, by itself, make a person a Guardian.
- Household: a shared space within the Service to which one or more Accounts and Members belong.
- Manager: a Member given permission to manage a Household.
- Member: a person recorded in a Household, whether or not they have an Account, including helpers such as cooks, cleaners, nannies, drivers and gardeners, and guests.
- Owner: the Account that created a Household, or to which ownership has passed.
- Policies: our Privacy Policy, Children's Privacy Notice for Parents and Guardians, Privacy Notice for Teens, Community and Acceptable Use Policy, AI Transparency Notice, Device Storage and Cookies Notice, Consumer Health Data Privacy Policy, and Account and Data Deletion Policy, each as updated under Section 29.
- Store: Google Play, the Apple App Store, or another platform from which you obtained the app.
- Child Sign-in: a sign-in linked to a Child Profile for a child who is at least 13 (or any higher minimum age under Section 6) and has not yet reached adulthood as described in Section 6.7, allowed by the child's Guardian under Section 6.
- Your Content: any content you submit to the Service, including text, messages, photos, videos, voice recordings, documents, files, records, lists and settings.
1.2 Interpretation. Headings are for convenience only. "Including" means "including without limitation".
2. The Service
2.1 What Domaiya does. Domaiya is a household organisation service. It helps members of a household to plan meals, track pantry and household supplies, manage shopping lists, assign tasks and cleaning, keep a shared calendar, store house notes, documents and memories, communicate in household chat, record bills, expenses and budgets, import statement entries, set medication reminders, and use voice and AI-assisted features.
2.2 For personal use. The Service is provided for your personal, domestic and household use. You must not use it to provide services to third parties for payment, or for any other commercial purpose, without our written consent.
2.3 The Service is an organisational tool. It is not a medical device, a financial service, a bank, a payment service, a childcare or safeguarding service, or an emergency service.
3. Eligibility
3.1 Standard Accounts. To create a standard Account you must:
- be at least 18 years old and have reached the age of majority where you live, if that is higher;
- have the legal capacity to enter into a binding contract where you live;
- not be prohibited from using the Service under any applicable law;
- not have had an Account suspended or terminated by us for breach of these Terms, unless we agree otherwise.
3.2 Children. Children may use the Service only as described in Section 6.
3.3 Your confirmation. By creating an Account you confirm that you meet these requirements. The same requirements apply to anyone who acts as a Guardian in the Service.
4. Your Account
4.1 Accurate information. You must give accurate and complete information when you create your Account, and keep it up to date.
4.2 Keeping your Account secure. You are responsible for keeping your sign-in methods confidential and secure: your password, phone, email account, and Google or Apple account.
4.3 Your Account is personal. You must not share it, let anyone else use it, or use anyone else's Account. This includes a child's Child Sign-in: a Guardian must never ask for, or use, a child's password (see Section 6.6).
4.4 Unauthorised use. Tell us immediately at info@berflowit.com if you suspect unauthorised use of your Account. We will never ask for your password or a one-time code.
4.5 Your responsibility. You are responsible for your own use and for taking reasonable steps to protect access under your control. You are not automatically liable for every act carried out with your credentials. Responsibility for unauthorised activity depends on the facts and applicable law, including our security and contractual duties. Nothing here removes mandatory rights.
4.6 Protective action. We may require you to verify your identity, or to sign in again, before certain actions (for example deleting your Account). We may also suspend access where we reasonably suspect unauthorised use.
5. Households, roles and responsibilities
5.1 Creating a Household. When you create a Household, you become its Owner.
5.2 Joining. People may join a Household by invitation or join code. Where the Household requires approval, an Owner or Manager must approve them.
5.3 Roles and visibility. The Owner and Managers decide who belongs to the Household, each Member's role, and the Household's visibility settings. Roles determine what each Member can see and do, as described in our Privacy Policy. Owners and Managers are responsible for:
- assigning roles and visibility settings carefully and appropriately;
- keeping the Household's membership up to date and removing people who should no longer have access;
- reviewing what is visible to children, helpers and guests before sharing sensitive information such as house documents, financial records, health information or chat;
- ensuring that anyone added to the Household may lawfully be added.
5.4 Information about other people. If you add information about another person, you confirm and promise that:
- you are entitled to add it and have a lawful basis for doing so;
- for a child, you are the child's Guardian;
- before entering another adult's health information, obtain that adult's separate approval for storage, for any sharing and for any AI use. Permission for one purpose is not permission for the others. Your statement does not replace that adult's own consent where the law requires it (see the Privacy Policy, Sections 3.2 and 14);
- you have told the person, where appropriate, how their information will be used, and have pointed them to our Privacy Policy;
- you will not use the Service to monitor, track, control or profile any person unlawfully or without appropriate authority.
Being able to enter information about a person in the Service does not show that the person agreed, and does not make you their Guardian.
5.5 Helpers. You remain responsible for your employment or service arrangements with people working in your home, including applicable pay, tax, social-security, working-time and safety duties. Domaiya does not itself make us their employer or placement agency. Helpers who use Domaiya nevertheless have their own contractual and data-protection rights against us; this clause does not remove our duties to them.
5.6 Messages to people without an Account. If a supported feature lets you send an email to someone who does not use Domaiya, you must have authority to use their address and they must expect and agree to receive the message. You must stop if they ask you to. Recipients can contact us directly under Section 13.6. Optional household SMS reminders are currently unavailable. That reminder feature requires the recipient's own verified Domaiya account, membership of the same Household and their affirmative reminder choices; it does not send household SMS reminders to non-account contacts.
5.7 Leaving and ownership.
- A Member who wants to leave a Household can ask the Owner or a Manager to remove them, or write to info@berflowit.com. We will never ask you for another person's sign-in details. You may also delete your Account at any time.
- If an Owner deletes their Account while other Members remain, ownership passes to an existing adult family Member who manages the Household. If there is none, the deletion does not go ahead until the Owner appoints one.
- If an Account is deleted and no other Members remain in its Household, that Household and its records are deleted. Shared records in a Household that continues follow Section 5.8 and the Privacy Policy, Section 9.
5.8 Shared content: ownership, access and what happens when you leave.
- Ownership does not change. You keep the rights you hold in content you add to a shared area. Placing content in a Household does not transfer ownership to us, to the Owner, to a Manager or to any other Member.
- Permission to show it. By adding content to a shared area, you allow the Members who are permitted to see that area to view and use it within the Service (Section 8.3), and you allow us to host and display it to them (Section 8.2).
- After you leave. Leaving a Household, or deleting your Account, ends your own access. It does not automatically erase shared records that the remaining Members are entitled to keep, such as a bill you entered or a message you sent. Our Account and Data Deletion Policy lists what remains.
- Your personal information in shared records. If shared records still identify you, you can ask us to review them. We will consider your request under data-protection law and will not refuse it simply because the records are shared.
5.9 Disputes within a Household. Domaiya does not adjudicate private disagreements between members. We may assist within the service’s role and applicable law. This does not excuse our own obligations concerning privacy, safety reports, unlawful content, service performance or lawful orders, and does not prevent a member exercising their rights directly.
6. Children
Current sign-in limits. Creating a child profile does not create a separate supervised account or send a child invitation. An account may nevertheless be linked to a member with the child role. The current sign-in and role controls do not verify age, legal guardianship or a guardian's permission. They must not be treated as a verified parental-control system. The age policy below and the restriction on children using AI still apply; technical access does not establish eligibility.
Minimum sign-in age. The minimum age for a supervised child sign-in is 13. Where applicable local law requires a higher minimum age, that higher age applies. A younger child may have a profile managed by their legal guardian but must not have their own sign-in. A household role, phone ownership or adult-managed profile does not itself prove age, guardianship or consent. This minimum does not confer eligibility to use an AI feature.
6.1 Child Profiles. A Guardian who manages a Household may create a Child Profile for their child. A child under 13 must not have their own sign-in; use a Child Profile instead. You must not let a child use your Account.
6.2 Child Sign-ins (from age 13 until adulthood). A Guardian may allow their child who is at least 13, and has not yet reached adulthood as described in Section 6.7, to sign in with a login linked to the child's Child Profile in the Guardian's Household. Only a Guardian may do this. The Domaiya app does not verify a person's age or guardianship, so we rely on the adult who manages the Household to set up children's profiles, sign-ins and roles correctly.
6.3 Guardian obligations. By creating a Child Profile or allowing a Child Sign-in, you confirm that you are the child's Guardian, and you agree to:
- supervise the child's use of the Service, and keep their role and the Household's visibility settings appropriate for the child;
- make sure the child understands and follows these Terms and the Community and Acceptable Use Policy;
- be responsible for the child's use of the Service, to the extent the law allows;
- keep the child's login details safe;
- remove the child's access, or ask us to delete the child's Account, if you withdraw your permission or no longer wish the child to use the Service.
6.4 What the child role can see and use.
- The ordinary child-role permissions exclude money and settings changes. Access also depends on account ownership and permissions; a role label is not an age check or a guarantee of restricted access. Basic Household details, such as its name, location and access settings, can be available.
- The child role can see household chat, Everyday notes (excluding the protected House documents area), memories, calendar and tasks.
- Roles are set by the Owner and Managers. Decide what to share, and which role to give, with this in mind.
6.4A AI Features and children. Information a Guardian adds to a Child Profile, such as allergies and dietary needs, is used by AI Features for meal planning, as described in our AI Transparency Notice. AI Features are for adult users: a Guardian who allows a Child Sign-in must not let the child use AI Features, and remains responsible for supervising the child's use of the Service.
6.5 Unauthorised use by children. If we reasonably believe an Account is used by a child without their Guardian's permission, or in breach of this Section, we may suspend it while we check, and may then delete it or ask a Guardian to confirm their permission.
6.6 Requests about a child. A guardian or child may write to info@berflowit.com about access, correction, deletion or withdrawal. Do not obtain or share the child’s password or sign-in code. Proportionate identity and authority checks must respect the child’s age, rights and safety.
6.7 Reaching adulthood. When a person with a Child Sign-in is at least 18 and has reached the age of majority where they live, if higher, their Guardian's authority over their Account ends and these Terms apply to them as an adult. They can ask the Owner or a Manager to change their role, or contact info@berflowit.com.
7. Licence to use the app
7.1 Our licence to you. Subject to your compliance with these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to:
- download and install the app on devices you own or control; and
- use the app and the Service for your personal, domestic and household purposes,
in each case in accordance with these Terms and the usage rules of the Store.
7.2 Restrictions. You must not, and must not permit anyone else to:
- copy, modify, translate, adapt or create derivative works of the app or the Service, except as permitted by law;
- decompile, disassemble or reverse engineer the app, except to the extent expressly permitted by applicable law despite this restriction;
- rent, lease, lend, sell, resell, sublicense, distribute or otherwise make the Service available to any third party;
- remove, alter or obscure any proprietary notice or label;
- use the Service to build or benchmark a competing product, or copy its features, design or content for that purpose;
- access the Service by automated means (including scrapers, bots and crawlers), except through features we provide;
- circumvent, disable or interfere with any security, access control, usage limit or rate limit;
- use the Service in breach of any law, including export-control and sanctions laws.
7.3 Updates. The licence covers updates, upgrades and replacements we provide, unless they come with separate terms.
8. Your Content
8.1 Ownership. You keep all rights you have in Your Content.
8.2 Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt, transmit, display and delete Your Content. Adapting includes, for example, resizing images, transcribing audio or extracting text from documents. We may do these things for as long as Your Content is held in the Service, and afterwards for as long as needed to complete deletion or meet legal obligations, and only to:
- operate, provide, secure and support the Service for you and your Household;
- display it to the Members who are permitted to see it;
- perform the features you use, including AI Features, through our service providers;
- comply with law, and enforce these Terms.
This licence does not allow us to sell Your Content, use it for advertising, or use it to train AI models.
8.3 Licence to your Household. By adding content to a Household, you permit the Members who are allowed to see it to view and use it within the Service.
8.4 Your promises about Your Content. You confirm and promise that:
- you own Your Content, or have all rights, licences, consents and permissions needed to submit it and to grant the licences in this Section;
- Your Content, and our use of it under these Terms, will not infringe any person's intellectual property, privacy, data protection or other rights, or break any law;
- Your Content complies with the Community and Acceptable Use Policy.
8.5 No duty to monitor. We do not pre-screen Your Content and are not obliged to monitor it. However, we may review, restrict or remove content in accordance with Section 20 and the law.
8.6 Backups are your responsibility. The Service is not a backup, archival or records-retention service. Keep your own copies of important documents and information, such as bills, receipts, contracts, insurance papers, medical instructions and photos. We are not responsible for loss of Your Content except as set out in Section 25.
8.7 Chat. The standard chat screen does not provide a general edit or delete control for sent messages. A supported assistant action may have its own time-limited undo, and account deletion or an assisted rights request has separate effects. None of these actions recalls a message or notification already delivered to another person. Shared-history retention follows Section 5.8.
9. Acceptable use
9.1 You must comply with our Community and Acceptable Use Policy, which forms part of these Terms.
9.2 In particular, you must not use the Service to:
- harass, bully, threaten, intimidate, stalk or abuse anyone;
- post or share content that is unlawful, hateful, sexually explicit, violent, defamatory or deceptive;
- post or share any content that sexualises, exploits or endangers children;
- invade anyone's privacy, or share their personal information without authority;
- infringe intellectual property rights;
- send spam, or unsolicited or unwanted messages;
- impersonate anyone, or misrepresent your identity, age or authority;
- upload malware, or attempt to gain unauthorised access to any Account, Household, system or data;
- interfere with, overload or disrupt the Service or its infrastructure;
- use AI Features to generate unlawful or harmful content, or to extract the underlying models, prompts or instructions;
- commit or facilitate fraud or any other unlawful activity.
10. Artificial intelligence features
10.1 What they are. AI Features use generative AI models provided by our service provider, Google Cloud (Vertex AI). When you use them, you are interacting with an AI system. Our AI Transparency Notice explains what data each feature uses.
10.2 Information. Our AI Transparency Notice and Privacy Policy explain which features use AI and what information each one sends.
10.3 Outputs may be wrong. AI outputs are generated automatically and may be inaccurate, incomplete, out of date, inappropriate or inconsistent. This includes extracted amounts and dates, categories, transcriptions, nutrition and calorie estimates, allergen information, meal plans, suggestions and generated pictures.
You are responsible for reviewing and checking any output before you rely on it or act on it. Scanned results are shown to you for review before they are saved.
10.4 The assistant does not act without you. When the assistant proposes to change your Household's records or send a message, it shows you the proposal and makes no change until you confirm. Review the proposed action before confirming. Your confirmation does not waive our duties or mandatory remedies if the service misrepresents or incorrectly applies the action.
- Confirmed actions are recorded.
- Undo is offered for a limited time, and may not be possible if the record has since changed or other changes depend on it.
- A message or notification that has been delivered cannot be recalled.
10.5 Generated pictures are illustrative only. They do not show your actual food, products or home.
10.6 Not professional advice. AI outputs are not medical, dietary, nutritional, financial, tax, legal or other professional advice (see Sections 11 and 12).
10.7 Reporting. You can report an offensive, unsafe or inaccurate AI output by writing to info@berflowit.com.
10.8 Changes to AI Features. We may change or replace the models behind AI Features, for example when a provider retires a model. Changes to the features themselves follow Section 17.
11. Health, nutrition and medication information
11.1 Not a medical device. Domaiya is not a medical device. It does not provide medical, dietary, nutritional or pharmaceutical advice, diagnosis, treatment or monitoring, and it is not a substitute for a healthcare professional.
11.2 Allergens and nutrition. Nutrition scores (such as Nutri-Score and NOVA groups), ingredient lists, allergen information, calorie estimates and household-product assessments come from:
- third-party databases (such as Open Food Facts), which are maintained by volunteers and may be incomplete, inaccurate or out of date;
- AI estimates;
- information entered by users.
Always read the product label and packaging. Where anyone in your Household has an allergy, intolerance or medical dietary requirement, you must not rely on the Service to identify allergens or safe foods.
11.3 Medication reminders. They are a convenience only. They may fail, be delayed or not be delivered, for example because notifications are turned off or silenced, the device is offline, off or in a power-saving mode, the operating system restricts the app, or our systems or providers are unavailable.
- Always follow the instructions of your doctor or pharmacist and the medicine's information leaflet.
- Do not use the Service as your only means of remembering to take medication, or of reminding someone else.
11.4 Emergencies. The Service is not designed for emergency communication. In an emergency, contact your local emergency services.
12. Money features
12.1 Records and estimates only. Budgets, bills, expenses, receipts, imported statement entries, savings targets, pace indicators, projections, affordability checks and insights help you organise household finances. They are records and estimates based on the information in the Service.
- They are not your bank balance.
- They are not financial, investment, tax, credit, accounting or legal advice.
- They are not a recommendation to take or avoid any financial decision.
12.2 No banking or payment functions. The Service does not connect to your bank, hold money, make or receive payments, or provide credit.
- Marking a bill as paid does not pay it.
- You remain responsible for paying your bills and obligations on time, and for checking amounts, dates and payees against the original documents.
12.3 Imported statements. They are read automatically and may be misread or miscategorised. Check the extracted entries.
12.4 Household records. Recording who paid or owes what does not itself make Domaiya a lender, payment service or enforcer of a repayment agreement. This clause does not determine whether Members have a valid separate agreement, or prevent a record being used as evidence where the law permits.
13. Reminders, notifications and messages
13.1 Reasonable efforts only. Reminders, notifications, emails and text messages are provided on a reasonable-efforts basis and may be delayed, duplicated or not delivered. Do not rely on them for time-critical, safety-critical or legally significant matters.
13.2 Factors outside our control. Delivery depends on your device, its settings, your network, and third-party providers.
13.3 Charges. Your mobile operator's or internet provider's standard charges may apply to messages you send or receive and to data you use.
13.4 Lock-screen content. Notifications may show message text and medication details on your lock screen. You are responsible for your device's notification and lock-screen settings.
13.5 What is included and what is limited.
- Always included, on every plan: household chat, push notifications, and essential account and security messages (for example sign-in codes, email verification and password reset).
- Email reminders are available through the features and settings shown in the app. Optional household SMS reminders are currently unavailable. When enabled, they require the recipient's verified phone number and consent, membership of the sending Household, an authorised payer's approved spending limits and available credits. Another member cannot provide the recipient's consent.
13.6 Stopping messages. Contact info@berflowit.com about unwanted messages sent at a Household's request. You do not have to contact the Household first, for example if that would be unsafe. For optional SMS reminders, when enabled, you can withdraw in the app or reply STOP. This prevents new sends; it cannot recall a message already accepted by the provider. START alone does not renew consent: the required provider opt-in reply, fresh ownership verification and new affirmative in-app choices are needed.
13.7 What delivery statuses mean. When the app shows that a message was sent, it means the message was handed to the delivery provider. It does not prove that the message arrived or was read. The app shows the most specific status it has.
14. Third-party services and data
14.1 Third-party services. The Service works with services and content provided by third parties, including:
- Google and Apple sign-in;
- Google Cloud, Firebase, Twilio and Resend;
- Open Food Facts, Open Beauty Facts and Open Products Facts;
- Open-Meteo;
- TheMealDB;
- web pages you ask us to import recipes from.
Your use of a third-party service may be subject to that third party’s terms and privacy policy. We do not control independent websites or all third-party content, and their availability or accuracy can vary. Using a provider does not remove our own responsibilities for selecting and using providers, protecting personal data, or supplying the Service with the care and conformity required by law. Responsibility is assessed under Sections 24–25 and applicable law.
14.2 Attributions.
- Product information: © Open Food Facts contributors. The database is licensed under the Open Database License, and its contents and images are licensed under Creative Commons licences (see openfoodfacts.org).
- Weather data by Open-Meteo.com, licensed under CC BY 4.0.
- Meal images: TheMealDB (themealdb.com), where shown.
14.3 Recipe imports. When you import content from a web page, you are responsible for making sure your use of that content is lawful.
15. Domaiya Premium and paid features
15.1 Currently free. Until Premium purchases are available in the version of the app you use, the Service is free of charge. Features labelled as premium may be available to testers at no cost. That test access is temporary and may end when purchases become available.
15.2 Before any paid feature is offered. If we introduce paid features, we will publish their terms, including price, renewal, cancellation, any trial and your withdrawal rights, and the purchase screen will show them before you buy. Nothing is charged without a purchase you confirm in the Store. Deleting the app or your Account never cancels a Store subscription by itself.
16. Pre-release and testing versions
16.1 What testing versions are. Internal, closed and open testing versions are pre-release software and may contain errors or change during testing. This status does not remove mandatory privacy, consumer or paid-service obligations. Any suspension, withdrawal or material change remains subject to Sections 17, 24 and applicable notice and remedy requirements.
16.2 Use with care. Do not rely on testing versions for anything important, and keep your own copies of important information.
16.3 Purchases in testing versions. Installing a testing version does not make purchases free. A purchase is a test transaction only when the Store treats your Google account as a licence tester and shows a test payment method. If you confirm a purchase with a real payment method, you can be charged.
16.4 Testing feedback and privacy. You may give honest feedback and report problems. Protect other people’s private information when sharing a screenshot or recording. These Terms do not impose a blanket confidentiality duty on testers, prohibit lawful reviews, or restrict reports to regulators, advisers or authorities. A separately agreed confidentiality obligation, if any, has its own lawful scope.
17. Availability, changes and support
17.1 Availability. We aim to keep the Service available and working, but we do not guarantee that it will always be available, uninterrupted, timely, secure or error-free. We may suspend the Service temporarily for maintenance, updates, security or reasons outside our control.
17.2 Updates we must provide. We provide the updates, including security updates, needed to keep the Service in conformity with these Terms.
17.2A Other changes to the Service. We may make other changes for a valid reason, for example to improve features, to adapt to technical changes, for security, or because a third-party service changes or the law requires it. We will not use a change to avoid an obligation we owe you, impose an unagreed charge or retroactively obtain consent. Changes under this clause are made without additional cost to you; separately chosen paid features still require a distinct purchase.
- If a change affects your access to or use of the Service more than in a minor way, we will tell you in advance, on a durable medium such as email or an in-app message you can keep, with the date and nature of the change.
- If you are a consumer and the law gives you a right to end the contract free of charge because of such a change (for example under Article 19 of Directive (EU) 2019/770), you may use it within the period and on the conditions the law sets. If we offer to let you keep the unchanged service at no extra cost, we will say so.
17.3 Installing updates. Some updates may be necessary for the Service to keep working. If you do not install an update, the Service may not work properly.
17.4 Ending the Service. We may discontinue the Service. We will give you reasonable advance notice, and at least any period the law requires, and an opportunity to export your data. If you have paid for a period that will not be provided, you are entitled to a proportionate refund.
17.5 Support. Support is available by email at info@berflowit.com. BERFLOW LTD, not the Stores, is responsible for maintenance and support of the app. We do not promise a fixed response time.
18. Intellectual property
18.1 Ours. The Service and everything in it (other than Your Content and third-party content) is owned by BERFLOW or its licensors and is protected by copyright, trade mark, database and other intellectual property laws. This includes the software, source and object code, design, text, graphics, icons, the Domaiya name and logo, and the BerflowIT brand.
18.2 No other rights. Except for the licence in Section 7, no rights are granted to you. All rights not expressly granted are reserved.
18.3 Brand use. You must not use our names, logos or trade marks without our prior written permission.
19. Feedback
19.1 If you voluntarily send ideas, suggestions or feedback, you permit us to use that feedback to evaluate, maintain and improve the Service without an obligation to pay for the suggestion. This permission does not transfer ownership of your existing work, authorise advertising use of your personal information, expand our content licence, or waive privacy, confidentiality or statutory rights. Personal information in a report remains governed by the Privacy Policy.
19.2 We will not identify you publicly as the source without your permission.
20. Reporting, moderation and complaints
20.1 Reporting in the app. You can report a message or Member from within the chat, and block Members. If someone is in immediate danger, contact your local emergency services first.
20.2 Notices of illegal content. Anyone may notify us of content they believe is illegal by writing to info@berflowit.com. The notice should include:
- a sufficiently substantiated explanation of why the content is illegal;
- a clear indication of where the content is;
- the notifier's name and email address (not required for notices concerning certain offences involving child sexual abuse);
- a statement that the notice is made in good faith and is accurate and complete.
20.3 How we act. Notices and reports are reviewed by people BERFLOW LTD authorises for this purpose. We aim to handle them diligently, objectively and without undue delay, and we do not promise a fixed response time. We may:
- remove content, or restrict access to it;
- restrict features;
- warn users;
- suspend or terminate Accounts;
- report matters to the competent authorities where required;
- take no action where we find no breach.
20.4 Statement of reasons. Where we restrict your content or Account, we will give you a clear statement of the reasons, unless the law prevents it.
20.5 Complaints and review. You may complain about any moderation decision, and ask us to review it, by writing to info@berflowit.com within six months of the decision. We will handle complaints in a timely, diligent, non-discriminatory and non-arbitrary way, and will reverse decisions that were wrong.
20.6 Repeated misuse. Repeated manifestly illegal content or deliberately abusive reporting may justify proportionate restrictions, subject to applicable warnings and review rights. A report is not abusive merely because it is unproved, critical of us or inconvenient. This clause does not suspend privacy requests, legitimate safety complaints or other statutory rights, and does not assume that every rule for a public social network applies to a private household service.
20.7 Point of contact. Our single point of contact for users, and for authorities under the EU Digital Services Act, is info@berflowit.com. Communications may be in English.
21. Copyright complaints
21.1 How to complain. If you believe content in the Service infringes your copyright or other intellectual property rights, write to info@berflowit.com and include:
- identification of the protected work;
- the location of the allegedly infringing content;
- your name, address and email;
- a statement that you believe in good faith that the use is not authorised by the rights holder or the law;
- a statement that the information is accurate and that you are the rights holder or authorised to act for them;
- your physical or electronic signature.
21.2 What we do. We may remove or disable the content, and will inform the user who posted it, who may respond.
21.3 Repeat infringers. We may terminate the Accounts of repeat infringers.
22. Suspension and termination
22.1 By you. You may stop using the Service at any time. You may delete your Account in Settings, or by following our Account and Data Deletion page.
22.2 By us. We may suspend or terminate your access to all or part of the Service, or remove content, if:
- you materially or repeatedly breach these Terms or the Policies;
- we are required to do so by law, a court or a competent authority;
- your use poses a risk of harm to other users, third parties, the Service or us;
- we reasonably suspect fraud, unauthorised access or misuse;
- your Account has been inactive for an extended period, after reasonable notice to you;
- we discontinue the Service under Section 17.4.
22.3 How we act. Where reasonable and lawful, we will tell you the reasons in advance and give you an opportunity to respond. Where the risk is serious or the law requires it, we may act immediately.
23. Effect of termination; your data
23.1 When your Account ends:
- your licence to use the app ends;
- your personal data is handled as described in our Privacy Policy and Account and Data Deletion page;
- content you contributed to a Household with remaining Members stays with that Household (Section 5.8).
23.2 Exporting before you go. Before deleting your Account, you can export your account data in Settings. The automatic export does not include everything; our Privacy Policy (Sections 9–10) explains what it covers and how to ask for the rest.
23.3 Provisions that continue. Sections 5.4, 5.5, 5.8, 5.9, 8.2 (for the purposes of completing deletion and meeting legal obligations), 8.4, 8.6, 10.3–10.6, 11, 12, 13.1, 14, 18, 19, 23, 24, 25, 26, 32 and 33 continue after your Account ends.
24. Our responsibilities and the Service's limits
24.1 What we promise. We will provide the Service with the reasonable care and skill required by law, and in conformity with these Terms.
24.2 Consumer rights. If you are a consumer, you have statutory rights in relation to digital content and digital services, including rights about conformity, updates, price reduction, refunds and ending the contract. Nothing in these Terms affects those rights.
24.3 What the Service is not. Domaiya is an organisational tool. It does not replace a bank, a payment service, a healthcare professional, an emergency service or another qualified adviser. You should check source documents, amounts, dates, product labels and allergens before relying on a result.
24.4 What we do not promise. To the extent the law allows, and without limiting Sections 24.1 and 24.2, we do not promise that:
- AI output, third-party data, nutrition or allergen information, or financial estimates will always be accurate or complete;
- the Service will always be available, uninterrupted or error-free;
- every reminder, notification or message will be delivered;
- the app will work on every device or operating system.
These statements do not release us from responsibility for our own failure to use reasonable care and skill, or to provide the Service in conformity with these Terms. Using a supplier does not, by itself, remove our obligations to you.
25. Liability
25.1 Liability we never exclude or limit. Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- wilful misconduct or gross negligence;
- any other liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection and product-liability law.
25.2 Losses we are responsible for. If we break these Terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result of that failure. Loss or damage is foreseeable if it is obvious that it will happen, or if you and we knew it might happen when the contract was made. Whether a loss can be recovered remains subject to the law's rules on causation, foreseeability and mitigation.
25.3 Responsibility assessed under law. A claim is assessed on its facts under applicable law, including the connection between the conduct and loss and any legally relevant contribution to that loss. We do not exclude our responsibility simply because an AI output was wrong, another Member acted, a provider failed, or a reminder was delayed. The information-checking guidance elsewhere in these Terms does not waive a claim or transfer our legal duties to you.
25.4 No blanket exclusion by type of loss. We do not use these Terms to exclude an otherwise recoverable loss merely by calling it indirect, consequential, financial or a business loss. Whether a loss is legally recoverable remains governed by applicable law. This provision does not turn Domaiya into a business service or change the permitted household-use scope.
25.5 No monetary cap. These Terms do not impose a contractual monetary cap on our liability. Our liability is determined under applicable law, including mandatory consumer rights. 25.6 Consumers. If you are a consumer, this Section applies only to the extent the mandatory law of the country where you live allows.
26. Your responsibility for unlawful use
26.1 Your own unlawful use. You are responsible for your own unlawful use of the Service, and for content you knowingly submit without the rights needed to do so. If the law makes you responsible for a loss we suffer because of that breach, we may seek to recover reasonable, evidenced losses to that extent.
26.2 Limits. This Section does not make you responsible for losses caused by our own breach, negligence or misconduct, and does not require you to defend us against claims.
26.3 Third-party claims. If we seek recovery from you in connection with a claim by someone else, we will tell you the basis of the claim and give you a reasonable opportunity to respond. We will not settle a claim in a way that binds you to an admission or a payment without your agreement or a binding legal decision. Your statutory rights and defences remain available.
27. Events outside our control
27.1 Responsibility for an event outside our reasonable control is assessed under applicable law and Sections 24–25. This clause does not excuse a failure of reasonable care, contractual provider oversight, data protection or mandatory service remedies. A supplier outage alone does not automatically remove our responsibility. Examples include:
- failures of internet, telecommunications, cloud or other third-party infrastructure;
- natural disasters;
- epidemics;
- war;
- terrorism;
- civil unrest;
- cyber-attacks we could not reasonably prevent;
- actions of governments;
- strikes.
27.2 If such an event occurs, we will take reasonable steps to minimise its effects and will resume performance as soon as reasonably possible.
28. Privacy
28.1 Our Privacy Policy explains how we process personal data. You must read it before using the Service. Where you provide personal data about other people, you must comply with Section 5.4.
29. Changes to these Terms
29.1 Why we may change these Terms. For valid reasons, including changes to the Service, changes in law or regulatory requirements, security reasons, and improvements in clarity.
29.2 How we tell you. Each version shows a version number and effective date. We will tell you about a material change in the app or by email, with reasonable advance notice before it takes effect, unless a change is needed sooner for legal or security reasons. We do not promise a fixed notice period beyond what the law requires.
29.3 Your options. We will tell you about a material change by email or in the app. If you do not agree, you may stop using the Service and delete your Account; you keep the ability to export your data.
29.4 What continued use does not mean. Continued use does not mean that you agree to a new use of sensitive information, that you give up a mandatory right, or that you approve a charge you have not confirmed.
29.5 Where to find versions. The current version is published on our website. Earlier versions are available on request from info@berflowit.com.
30. Communications and notices
30.1 Electronic communications. You agree that we may communicate with you electronically, in the app, by push notification, by email or by text message, about your Account and the Service. Electronic communications satisfy any legal requirement for communications to be in writing, to the extent the law allows.
30.2 Notices to us. Send notices to BERFLOW LTD at info@berflowit.com, or by post to Miltonos 109A, 3047 Limassol, Cyprus.
31. Assignment and subcontracting
31.1 By us. We may transfer our rights and obligations under these Terms to another organisation, for example as part of a reorganisation, merger or sale of our business. We will tell you if this happens and will make sure your rights under these Terms are not reduced. We may use subcontractors and service providers to provide the Service; we remain responsible for their performance under these Terms.
31.2 By you. You may not transfer your rights or obligations under these Terms without our written consent.
32. General
32.1 Entire agreement. These Terms, the Policies and any valid additional feature terms govern the service. This does not exclude fraud, mandatory pre-contract information, binding representations, statutory terms or rights that cannot lawfully be excluded. A revised document does not retrospectively remove accrued rights.
32.2 Severability. A provision that is invalid or non-binding is not enforced against you. The remaining contract continues only to the extent it can lawfully do so. Any replacement or adjustment must be permitted by applicable law; this clause does not authorise rewriting an unfair consumer term to make it enforceable.
32.3 No waiver. A delay or failure to enforce any right does not waive it.
32.4 Third-party rights. Except as stated in Section 35, no one other than you and us has any right to enforce these Terms.
32.5 Language. Translations should convey the same obligations and protections. A language-precedence clause must not deprive consumers of the mandatory meaning, transparency or interpretation rules applying to the terms presented to them. Resolve a material discrepancy fairly and in accordance with applicable law.
32.6 Export and sanctions. Use of the service must comply with sanctions and export-control rules that actually apply to the transaction and parties. We may restrict access where legally required. Nationality or residence alone is not represented as proof that use is prohibited under every sanctions regime.
32.7 Mandatory rights. If a provision conflicts with a right that the law makes mandatory, the provision applies only to the extent the law allows. Choosing Cyprus law does not deprive a consumer of mandatory protections of the country where they live.
33. Governing law and disputes
33.1 Governing law. These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by the laws of the Republic of Cyprus.
33.2 Consumers. If you are a consumer living in the European Union, the United Kingdom, Switzerland or another country whose law gives you the right, you also benefit from the mandatory provisions of the law of the country where you live. You may bring proceedings in the courts of that country. We may bring proceedings against you only in the courts of the country where you live.
33.3 Everyone else. If you are not a consumer, the courts of the Republic of Cyprus have exclusive jurisdiction.
33.4 Resolving disputes. You may contact info@berflowit.com so we can try to resolve a dispute. This does not delay or condition statutory rights, limitation periods, court access or complaints to an authority.
- Where an applicable law requires information about, or participation in, an alternative dispute-resolution process, we will comply.
- If we cannot resolve your complaint, we will tell you whether an alternative dispute resolution body is available for it and whether we will take part.
34. Additional terms for Google Play

To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are BERFLOW's responsibility.
e) Product claims. BERFLOW, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including:
- product liability claims;
- any claim that the app fails to conform to any applicable legal or regulatory requirement;
- claims arising under consumer protection, privacy or similar legislation.
f) Intellectual property. In the event of any third-party claim that the app, or your possession and use of it, infringes that third party's intellectual property rights, BERFLOW, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
g) Legal compliance. You represent and warrant that:
- you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
- you are not listed on any U.S. Government list of prohibited or restricted parties.
h) Developer contact. Questions, complaints or claims about the app should be sent to BERFLOW LTD, Miltonos 109A, 3047 Limassol, Cyprus, info@berflowit.com.
